Terms of Service

Welcome to SKRT. These Terms of Service ("Terms") govern your access to and use of the SKRT website, mobile experiences, and all related services (collectively, the "Services"), and form a binding agreement between you and SKRT JEWELRY AND APPAREL LLC, a Florida limited liability company ("SKRT," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility & accounts

1.1 Age requirement

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase from SKRT. If you are between 16 and 18, you may use the Services only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

1.2 Account creation

To make purchases more convenient, you may create an account. You are responsible for:

  • Providing accurate, current, and complete information
  • Keeping your login credentials confidential
  • All activity that occurs under your account

Notify us immediately at customersupport@iskrt.com if you suspect unauthorized access to your account.

1.3 One account per person

You may not maintain multiple accounts to abuse promotions, discount codes, or free shipping offers. SKRT may close duplicate accounts at its discretion.

2. Orders and acceptance

2.1 Order placement

When you place an order, you make an offer to purchase the listed products at the listed prices, subject to these Terms.

2.2 Order acceptance

We confirm receipt of your order by email — this is not acceptance of your offer. A binding contract is formed only when we ship the order or send a separate order confirmation. SKRT reserves the right to:

  • Refuse or cancel any order before shipment for any reason
  • Limit quantities purchased per person or per household
  • Verify information before processing an order
  • Refuse service to anyone for any lawful reason

2.3 Cancellation by SKRT

We may cancel an order if: - The item is out of stock - The price was listed incorrectly - Payment cannot be verified - We suspect fraud or unauthorized use - We believe the order violates these Terms

If we cancel, we will refund any payment in full to the original payment method.

2.4 Cancellation by you

Once an order has been processed for shipment, it generally cannot be cancelled. If you need to cancel, email customersupport@iskrt.com within 1 hour of placing the order. We'll do our best, but cannot guarantee cancellation.

3. Prices and payment

3.1 Prices

All prices on the Services are in U.S. dollars (USD) unless stated otherwise. Prices do not include taxes, customs duties, or shipping unless explicitly stated. Prices are subject to change without notice.

3.2 Pricing errors

If a product is listed at an obviously incorrect price (typographical error, manifest miscalculation), SKRT reserves the right to refuse or cancel the order, even after an order confirmation has been sent.

3.3 Payment

We accept major credit cards (Visa, Mastercard, American Express, Discover), Apple Pay, Google Pay, Shop Pay, PayPal, and select buy-now-pay-later options (Shop Pay Installments, Klarna, Afterpay) where available.

By providing payment information, you represent that: - The information is true, complete, and accurate - You are authorized to use the payment method - You will pay all charges incurred at the prices in effect

3.4 Taxes

Sales tax, VAT, or other applicable taxes will be calculated and added at checkout based on the shipping address. Customs duties on international orders are the responsibility of the buyer — see the Shipping Policy.

4. Shipping & delivery

Shipping is governed by our separate Shipping Policy, incorporated into these Terms by reference.

5. Returns, refunds, and warranty

Returns and refunds are governed by our Refund Policy and Returns & Exchanges page. Warranty service is governed by our Lifetime Fade-Free Warranty policy. All three are incorporated into these Terms by reference.

6. Product representations

6.1 Materials & specifications

SKRT product pages describe materials, dimensions, weights, and finishes as accurately as possible. Minor variations in color, finish, or measurements are normal for handcrafted and plated jewelry and do not constitute defects.

6.2 Plating

Gold-plated pieces are not solid gold. Our heavy 18K gold plating over 316L stainless steel is engineered for durability and longevity, but is plating — see Care Instructions and the Lifetime Warranty for details on what's covered.

6.3 Stones

Cubic zirconia ("CZ") is a synthetic gemstone — not natural diamond — unless a product is explicitly labeled "natural diamond" or "lab-grown diamond." CZ inclusions, slight color variations, and minor placement differences from setting to setting are characteristic of hand-set pavé jewelry.

6.4 Photography

We make every effort to display product photos accurately. Actual color may vary slightly due to monitor calibration, lighting, and photographic processing.

7. Intellectual property

7.1 SKRT's content

All content on the Services — including text, graphics, logos, product images, video, audio, downloads, designs, and software — is owned by SKRT or its licensors and protected by copyright, trademark, and other intellectual property laws.

The SKRT® name and logo are trademarks. All product designs are protected by copyright and/or design patents where applicable.

7.2 Limited license

SKRT grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may not:

  • Copy, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content from the Services
  • Use the Services for commercial scraping, data mining, or automated extraction
  • Reverse-engineer, decompile, or attempt to extract source code
  • Frame, mirror, or republish any part of the Services
  • Use SKRT trademarks, logos, or trade dress without prior written permission

7.3 User content

If you post reviews, photos, tags, or other content on or about SKRT, you grant SKRT a perpetual, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, distribute, and display that content in any medium for any purpose, including marketing. You represent that you have all rights necessary to grant this license.

8. User conduct

You agree NOT to:

  • Use the Services for any illegal purpose or in violation of any law
  • Misrepresent your identity or affiliate with another person without permission
  • Attempt to gain unauthorized access to the Services, other accounts, or any related systems
  • Interfere with the operation of the Services (DDoS, malware, etc.)
  • Use bots, scrapers, or automated tools to extract data from the Services
  • Harass, threaten, or abuse other users or SKRT staff
  • Post content that is unlawful, defamatory, obscene, infringing, or otherwise objectionable
  • Use the Services to spam, phish, or distribute malware
  • Resell SKRT products without prior written authorization

9. Promotions, discounts, and rewards

  • Discount codes, promotional offers, BOGO offers, and loyalty rewards are subject to specific terms displayed at the time of the offer.
  • One discount per order unless otherwise stated.
  • SKRT may modify, suspend, or terminate any promotion at any time.
  • Promotions are void where prohibited.

10. Disclaimers

THE SERVICES AND ALL CONTENT, PRODUCTS, AND SERVICES OBTAINED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT FOR THE EXPRESS LIMITED WARRANTY DESCRIBED IN THE LIFETIME WARRANTY POLICY.

SKRT does not warrant that: - The Services will be uninterrupted, error-free, or secure - Defects will be corrected - The Services or servers are free of viruses or harmful components - Any specific result will be obtained from using the Services

11. Limitation of liability

To the maximum extent permitted by law, in no event shall SKRT or its directors, officers, employees, affiliates, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses) arising from or in connection with:

  • Your use of, or inability to use, the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

SKRT's total cumulative liability to you for any and all claims arising from or related to these Terms or the Services shall not exceed the greater of (a) the amount you paid SKRT in the six (6) months preceding the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow limitation of certain liabilities, so portions of this section may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless SKRT and its directors, officers, employees, affiliates, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your breach of these Terms
  • Your violation of any law or third-party right
  • Your use or misuse of the Services
  • Content you post on or about SKRT

13. Governing law and dispute resolution

13.1 Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

13.2 Binding arbitration

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any SKRT product (a "Dispute") shall be resolved through binding individual arbitration, not in court, except as set forth below.

  • Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
  • Arbitration shall take place in Miami, Florida unless both parties agree otherwise.
  • The arbitrator's decision is final and binding.
  • Each party bears its own attorneys' fees and costs unless the arbitrator decides otherwise.

13.3 Class action waiver

You and SKRT agree that any Dispute will be resolved on an individual basis only. You waive any right to bring or participate in a class action, mass action, or representative action. This waiver is a material part of these Terms.

13.4 Exceptions

The following are NOT subject to arbitration: - Small-claims court actions for amounts within that court's jurisdictional limits - Claims for injunctive relief related to intellectual property or unauthorized access to the Services - Disputes that cannot be required to be arbitrated under applicable law

13.5 30-day opt-out

You may opt out of the arbitration agreement by emailing customersupport@iskrt.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. Include your full name, address, and the date you first accepted these Terms.

14. Changes to these Terms

SKRT may modify these Terms at any time. Material changes will be communicated via email (where you've provided one) or a notice on the website. Continued use of the Services after changes take effect constitutes acceptance.

15. Termination

SKRT may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination, your right to use the Services ends immediately. Sections that by their nature survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution) will continue to apply.

You may stop using the Services at any time and request deletion of your account by emailing customersupport@iskrt.com.

16. Severability

If any provision of these Terms is found unenforceable, the remainder of the Terms shall continue in full force and effect.

17. No waiver

SKRT's failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

18. Entire agreement

These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, Returns & Exchanges page, Lifetime Warranty, Care Instructions, and TCPA Policy, constitute the entire agreement between you and SKRT regarding the Services, and supersede any prior agreements.
